Sent to the 6 years outdated address supplied by you to ebay, You blame us?
We feel so strongly about this that we e-mailed the following to him:-
We note that you have left negative feedback.
We consider your complaint not only unfair but also libellous.
- You bought our item on 22nd January 2004 for £3,200.
- We recorded positive feedback for you. "Payment received. Thanks." on 21-Feb-04 16:49
We have not yet checked back to see when your payment was received.
Some time ago (we will check dates later) you contacted us to complain that your goods had not arrived. As we had posted them several weeks before, we were very concerned about this, and started to track the goods. Because of loss problems with Fedex and reduced insurance cover, we mailed these in six packages by "International Signed For". We completed a claim form which we submitted to our post office.
Some time after we heard that some of them were on their way back to us, and most of them have now been returned to us. We will check later to ascertain whether they are all back safely.
- We sent the goods to the address provided to us by Ebay. This address was in turn provided by you to Ebay.
- You have now informed us that this is the wrong address!
- We are not mind readers, and we cannot be expected to guess that you have changed your address and failed to change your personal contact details record lodged with Ebay.
- Most Ebay members do keep their personal information up to date, indeed it appears to be a condition of use of Ebay. It is clearly your responsibility to communicate your correct address to Ebay sellers If you fail to update your personal address information you should not blame or seek to blame the seller for despatching to the published address.
- When we pointed this out to you, you told us a number of things, including :-
- The address you gave Ebay is six years out of date. We notice you have been a member since 4th May 1999, so we presume that it was correct at the time, which makes it under five years out of date depending on when you next changed address.
- You had changed addresses a number of times since.
- You cannot be bothered, or do not have the time to update your Ebay address record.
- We should not rely on information provided to us by a third party. (This ignores the fact that you provided it to Ebay).
- We should have telephoned you to ask for your address. (If we did this with every Ebay buyer, most would think we were stupid, inefficient or both).
- You had made a high value purchase, and you were entitled to receive a degree of service.
- The friend or third party who had forwarded your payment / purchase confirmation gave us your correct delivery address. (They did not, although there was an address on their document it gave no instructions about delivery).
- They should have done! (There you go again blaming everybody but yourself).
- Some people do have more than one address, in which case most of them manage to give clear instructions about which address to use. Anyone who has more than one address has clear responsibility for communicating the correct address to relevant parties, and can not reasonably blame anyone else if they fail to do so.
- You have also told us that you no longer want the goods because of the delay. Sorry but the delay was your fault.
- You told us you only wanted 25 of the coins anyway and were going to sell on the balance.
- You also asked could you have sovereigns instead. Although we were in no obligation to do so, we offered to exchange your half sovereigns for full sovereigns on a 2 for 1 basis.
- You accused us of making a totally unreasonable offer. We do not agree.
- You in turn made us an offer which was ludicrous. It involved us supplying sovereigns at less than our cost price.
- You have been rude and aggressive towards our staff.
- You have been totally unreasonable throughout.
- Posting negative feedback for us is utterly unreasonable under the circumstances.
- We believe the comments you made in your feedback are libellous. We expect to receive an unreserved apology and retraction without delay. We also expect you to send a copy of the apology and retraction to Ebay without delay, and request that they remove it. If you fail to do so we intend to draw this matter to Ebay's attention. We also intent to consult our legal
advisers about issuing legal proceeding against you for defamation. We advise you to consult your lawyers.
- Apparently you are a qualified doctor and work as a dentist. If you run your dental practice in a similar manner to that which you have handled this Ebay transaction, we would not like to be one of your patients.
Stubborn
Despite us investing much time and effort into trying to reach some sensible agreement with this buyer (we avoided the word understanding), he still firmly believes he is right and all the rest of the world is wrong.
We sent him a polite but firm request to retract his defamatory remarks, and he has not only refused but launched into further tirades. We feel so upset by this person that we have decided to publish most if not all of our correspondence. Although this will probably not help us to reach a solution, it may provide some light entertainment for some, and let others into the nightmare world of EBay Buyers From Hell. Please bear with us while this correspondence appears as it will take us some time to process and upload.
Name & Shame
It is our normal practice to respect customer confidentiality, and therefore we would not normally publicly identify our customers, however this person's continuing attitude that he is right and everybody else is wrong, coupled with his failure to retract his defamatory comments, lead us to the unusual step of naming and shaming him here.
He is Dr. David Jou, a dentist with a practice or surgery in Edmonton Canada.
